Terms of Use

1. Acceptance

By installing or using PlanetEar ("the app"), you agree to these Terms of Use. If you do not agree, please do not use the app. These terms are between you and the app's developer ("we", "us").

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, in accordance with the Apple Media Services Terms and these terms. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by law.

3. No account, no fee

The app is provided free of charge and requires no account, login, or subscription. We collect no payment and, as described in our Privacy Policy, operate no server that receives your personal data.

4. Third-party data

The app displays information from independent public data providers, including (but not limited to) Apple MapKit, adsb.lol, CelesTrak, the U.S. Geological Survey (USGS), Open-Meteo, and NASA/JPL. We do not own, control, or guarantee this data. It may be incomplete, delayed, inaccurate, or unavailable, and each provider's own terms apply to its data. The absence of an aircraft, satellite, event, or reading in the app does not mean it is absent in reality.

5. Not for safety-critical use

The app is provided for general interest, education, and entertainment only. It is not a navigational, aeronautical, meteorological, seismological, or emergency tool, and must not be used for any purpose where inaccurate, delayed, or missing information could lead to harm, loss, or damage. Always rely on official sources for such purposes.

6. Acceptable use

You agree not to use the app unlawfully, to interfere with or overload any third-party data provider, to attempt to gain unauthorised access to any system, or to use the app in any way that breaches a data provider's terms.

7. Intellectual property

The app, its name, its design, and its original code and content are owned by us or our licensors and are protected by intellectual-property laws. Third-party data, map imagery, textures, and trademarks remain the property of their respective owners and are used under their applicable licences, credited in-app under Settings → Data & Attribution.

8. Warranty disclaimer

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on information displayed in the app. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Changes

We may update the app and these terms from time to time. Material changes will be reflected on this page. Continued use of the app after changes take effect constitutes acceptance of the revised terms.

11. Governing law

These terms are governed by the laws of England and Wales, and you agree to the non-exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer-protection rights you may have where you live.
